Outside-work clauses in your employment contract

Your main job pays the bills, so it's worth checking that side work fits your contract before the first firing.

Clauses to look for

  • Outside work or exclusivity: some contracts require notice or permission before taking other paid work.
  • Non-compete: you may be restricted from working for competitors or the same clients.
  • Conflict of interest: overlap with your employer's business, clients or suppliers may need to be declared.
  • Company time and equipment: side work on work devices or during working hours is usually not allowed.
  • Intellectual property: some contracts claim ownership of what you create, especially if it relates to your role.

How to ask

Write to HR: describe the side work, when you'd do it, and confirm it won't use company time or equipment. Keep the reply.

When to get advice

If a clause is broad and your side work is close to your profession, talk to an employment lawyer or your union before starting.
